آليات التعاون الدولية لمكافحة الفساد وفق التشريع الجزائري

Abstract

نظرا للطابع الشمولي لجرائم الفساد وكونها تتعدى حدود الدولة الواحدة سواء من حیث أركانها أو آثارها، فإن مكافحتها والحد منها تتطلب تعاونا بین الدول على جمیع المستویات سواء من حیث التجریم والعقاب أو التعاون القضائي بتبادل الإجراءات القضائیة أو من حیث التعاون الأمني بین أجهزة الشرطة ومن حیث التعاون المؤسساتي بین المؤسسات المالیة وذلك من أجل متابعة مرتكبي هذه الجرائم وملاحقتهم في أي دولة، وهذا ما دفعنا إلى البحث في هذا الموضوع In view of the comprehensive nature of the crimes of corruption and the fact that they transcend the borders of the same State, both in terms of their elements and their effects, combating them requires,cooperation between States at all levels, both in terms of criminalization and punishment or judicial cooperation by exchanging judicial procedures or in terms of security cooperation between the police and institutional bodies among financial institutions In order to close the gates to the perpetrators of these crimes and follow them in any country they were, This is what prompted us to research this topic.
