قواعد إعلان الحرب دراسة مقارنة بين الفقه الإسلامي والقانون الدولي الإنساني

Abstract

تمع الدولي عامة والفقه الإسلامي خاصة ، 􀁾 يعد موضوع قواعد إعلان الحرب من المواضيع المهمة في ا تمع الدولي اليوم من صراعات و نزاعات في الساحة الدولية ، و ذلك بسبب الخرق 􀁾 نظراً لما يعانيه ا الذي يتم لهذه القواعد ،و هذا ما تم بحثه في هذه الدراسة بعنوان "قواعد إعلان الحرب بين الفقه الإسلامي و القانون الدولي الإنساني " و الهدف منها هو التعرف على المفاهيم الحربية لدى كل من الشريعة الإسلامية و القانون الدولي ، و مدى مشروعية كل منهما و الحماية المقررة لكل الفئات ، و الجزاء و المسؤولية المترتبة عند مخالفة هذه القواعد . كل ذلك تم وفق دراسة مقارنة بين كل من التشريعين ، حيث توصلت في الأخير إلى أن هناك توافق كبيراً بينهما ، نظراً لاشتراكهما في الحماية المقررة لكل من المحاربين و الغير محاربين وقت الحرب .The issue of the rules of declaring war is one of the important topics in the international community in general and Islamic jurisprudence in particular, given the struggles and conflicts that the international community is suffering today in the international arena, due to the breach of these rules, and this is what was discussed in this study entitled "The Rules of War". The declaration of war "between Islamic jurisprudence and international humanitarian law" The aim of which is to identify the concepts of war in both Islamic law and international law, the extent of their legitimacy and the protection prescribed for all groups, and the penalty and responsibility arising when violating these rules All of this was done according to a comparative study between each of the two legislations, where I concluded in the end that there is a great agreement between them, given their participation in the protection prescribed for both combatants and non-combatants in time of war
