تنازع الاختصاص القضائي بين الفقه الإسلامي والقانون الجزائري: (دراسة مقارنة)

Abstract

تناولت هذه الدراسة إشكالية تنازع الاختصاص القضائي في الفقه الإسلامي والقانون الجزائري من خلال دراسة وصفية تحليلية توضح حالاتها وصورها والحلول المقررة لها، وقد أوضحت الدراسة أنّ تنازع الاختصاص من الموضوعات ذات الأهمية في ظل العمل بالازدواجية القضائية، كما أبرزت أيضا أهمية الإلمام بمختلف جوانب محكمة التنازع بصفتهاجهاز تفادي حالات إنكار العدالة، بالإضافة إلى حيلولتها دون تناقض الأحكام النهائية الصادرة من الجهات القضائية الأمر الذي يحقق حماية قصوى للحقوق والحريات. وقد أوصلت الدراسة بضرورة الاعتناء بمحكمة التنازع باعتبارها هيئة قضائية سامية تضمن السير الحسن لنظام القضاء المزدوج عن طريق تحديد مجال اختصاص كل جهة قضائية للفصل في حالات التنازع المعروضة عليها. This study dealt with the problem of conflict of jurisdiction in Islamic jurisprudence and Algerian law through a descriptive and analytical study that clarifies its cases, images and solutions to it, and the study has shown that the conflict of jurisdiction is one of the important topics in light of the work of judicial duality, and also highlighted the importance of familiarity with the various aspects of the Court of Dispute as a device to avoid cases of denial of justice, in addition to preventing the contradiction of final rulings issued by the judicial authorities, which achieves maximum protection of rights and freedoms. The study informed the need to take care of the Dispute Court as a supreme judicial body that guarantees the proper functioning of the dual justice system by defining the area of competence of each judicial authority to adjudicate in cases of dispute submitted to it.
