المسؤولية الإدارية عن أعمال الشرطة

Abstract

يعد مرفق الشرطة من المرافق الحساسة نظرا لطبيعة المهام الموكلة له، المتمثلة في تحقيق المصلحة العامة في السياسة الأمنية للدولة، هذا ما يؤدي إلى قيام المسؤولية مرفق الشرطة الإدارية، سواء على أساس الخطأ، إذ يرتكب موظفو الشرطة أخطاء أثناء تأدية مهامهم أو خارجها أو منفصلي عنها، حيث تقيم هذه الأخطاء مسؤوليتهم الشخصية، كما تقم مسؤولية المرفق ذاته في حالة سوء تسيير المرفق، أو بطء في سيره أو عدم سير مرفق الشرطة في هذه الحالة يعود الاختصاص في نظرها إلى القضاء الإداري على عكس الخطأ الشخصي الذي يعود الاختصاص إلى القضاء العادي، أما عن المسؤولية بدون خطأ لمرفق الشرطة، فهي تعتبر أساس استثنائي قائم على نظرية المخاطر نتيجة استعمال الشرطة للأسلحة نارية قد تسبب أضرار للأفراد أو على أساس المساواة أمام الأعباء العامة والتي أصبح لكثير من الفقهاء ينادون بأن تصبح هذه الأخيرة في الأصل. The present research focused on a rooting approach of administrative responsibility emergency on the basis of the law through the presentation of ideas jurisprudential opinions , social conditions and legislative texts having contributed to the creation of this form of administrative responsibility , which was different from the responsibility of the existing administration , from its prejudicial actions in terms of its non judicial creation , through the pillars on which it's based , and through the provisions of compensation therein . As well as to presenting its most important applications in Algerian legislation in an analytical manner to the legal texts approved by the legislator and obliging the public administration to compensate damages caused by terrorist acts or incidents in the framework of the fight against terrorism , or caused by professional damage and risk as well as damages caused by natural disasters.
