حقوق المالك والمستأجر في التشريع الجزائري

Abstract

إن المشرع الجزائري عرف عقد الايجار من خلال نص المادة 05 (467) بأنه: "عقد يمكن المؤجر بمقتضاه المستأجر من الانتفاعبشيءلمدةمحددة مقابل بدلإيجار معلوم" من خصائصه انه عقد شكلي وملزم الى جانبين وهو من العقود المعاوضة الزمنية لكي ينعقد الإيجار صحيحا يجب أن يتوفر ركن التراضي، المحل، السببضف الى ذلك ركن الشكلية، بما أنه عقد ملزم الجانبين فإن أثاره تتوزع على عاتق طرفيه العقد فعلى المالك أولا تسليم العين المؤجرة وصيانتها وفي المقابليلتزم المستأجر بدفع بدل الايجار مقابل انتفاعه بالعين المؤجرة ويكون استعماله بطريقةسلمية دون إلحاق الضرر بها. في حالة إخلال أحد الطرفين بالتزاماته التعاقدية يمكن لطرف الاخر طلب فسخ العقد مع حقه في التعويض عن أي ضرر أصابه نتيجة ذلك. The Algerian legislatordefined the leasecontract in Article 467 as an agreement in which one party allows the other to use something for a specificperiod in return for payment. This type of contractisbothmutual and consensual, meaningitisbased on the agreement of both parties withoutneeding a writtenform. It isalso a bindingcontract, whereeachside has responsibilities to fulfill. The landlord must hand over the rentedproperty in good condition, while the tenant isrequired to pay the rent and take care of the property. If one party fails to respect their obligations, the other has the right to go to court to claim theirrights and mayask for compensation for anyharmthey have suffered.
