سليمة, طلحاوي2024-09-232024-09-232022https://dspace.univ-ghardaia.edu.dz/xmlui/handle/123456789/8678Tahqiq -manat (establishment of the effective cause) is thought to be the core of religious Ijtihad(independent scholarly reasoning) and one of the fundamental principles for applying the rules and extending them to secondary related issues and incident , This research is meant to highlight the importance of establishing the effective cause in unprecedented matters and incidents through elucidating the concept along with the definition of nawazil (unprecedented incidents), in addition to shedding light on the different degrees and restrictions of verifying the effective cause. The research dedicated a practical study to the newly-occurred issue of slaughtering by means of modern electrical machines where the question is tackled with regard to the views of religious jurists and in accordance with the way of establishing the effective cause in terms of the slaughtering method.
