Item التعيين في الوظائف السامية في الدولة(جامعة غرداية، كلية الحقوق والعلوم السياسية، قسم الحقوق, 2025-07-15) نجار, صليحة; جبريط, مباركةتهدف مذكرة التخرج هذه إلى دراسة وتحليل عملية التعيين في المناصب السامية للدولة، وهي الوظائف التي تتسم بأهمية قصوى في تسيير الشأن العام وتوجيه السياسات الوطنية. تركز الدراسة على الإطار القانوني والمؤسساتي الذي يحكم هذه التعيينات، بالإضافة إلى المعايير والإجراءات المتبعة لضمان الكفاءة والنزاهة في اختيار شاغلي هذه المناصب. تتناول المذكرة أهمية هذه المناصب في تحقيق الحوكمة الرشيدة وتعزيز فعالية الإدارة العمومية، وتبرز التحديات التي قد تواجه عملية التعيين، مثل تأثير المحسوبية أو الضغوط السياسية. كما تستعرض المذكرة بعض التجارب المقارنة في دول أخرى للاستفادة من أفضل الممارسات في هذا المجال. تخلص المذكرة إلى تقديم توصيات لتحسين وتطوير آليات التعيين في المناصب السامية، بهدف ضمان الشفافية، الكفاءة، والمساواة في الفرص، بما يخدم المصلحة العامة ويعزز بناء دولة قوية. This graduation thesis aims to study and analyze the process of appointing individuals to high-ranking state positions. These are roles of utmost importance in managing public affairs and directing national policies. The study focuses on the legal and institutional framework governing these appointments, as well as the criteria and procedures followed to ensure competence and integrity in the selection of those who fill these positions. The thesis addresses the significance of these positions in achieving good governance and enhancing the effectiveness of public administration. It highlights the challenges that may face the appointment process, such as the impact of favoritism or political pressures. The thesis also reviews some comparative experiences in other countries to benefit from best practices in this field. The thesis concludes by offering recommendations for improving and developing the mechanisms for appointment to high-ranking positions. The goal is to ensure transparency, efficiency, and equal opportunities, thereby serving the public interest and fostering the building of a strong and effective state.Item النظام القانوني للمرصد الوطني للمجتمع المدني(جامعة غرداية، كلية الحقوق والعلوم السياسية، قسم الحقوق, 2025-06-12) سنقاري, محمد أسامةيعتبر المجتمع المدني عنصرا فعالا من خلال مشاركته التي تساهم في التنمية المحلية والوطنية المستدامة، ويبرز دوره من خلال الهيئة الاستشارية القانونية تحت مسمى المرصد الوطني للمجتمع المدني والتي تعتبر معقل الكفاءات والإطارات، فمن خلالها يصل صوت المواطن إلى السلطة، لأنها تعتبر الوسيط بين الدولة والمجتمع، إذ هي اللبنة الرئيسية أو الركيزة المؤكدة لاسترجاع حقوق المواطن وهو ما يصبوا إليه، هذا ما يبرر سياسة الدولة الرشيدة في الاهتمام بالشعب الذي يعتبر أحد الأركان الأساسية للدولة، بإشراك فواعله في القرار السياسي وتقرير مصير الدولة في قراراتها المحورية، من خلال الكفاءات والإطارات خريجي الجامعة الجزائرية، إضافة إلى دور المنظمات الطلابية العلمية وذلك بتلقي اقتراحاتهم وآرائهم في شتى المجالات ومعالجتها بطريقة علمية. Civil society is an effective element through its participation, which contributes to sustainable local and national development. This role is highlighted by the legal advisory body, the National Observatory for Civil Society, which is a stronghold of competencies and cadres. Through it, the citizen's voice reaches the authorities, as it serves as the mediator between the state and society. It is the main building block or sure foundation for restoring citizens' rights, which they aspire to. This justifies the state's wise policy of caring for the people, who are one of the fundamental pillars of the state, by involving their actors in political decision-making and determining the fate of the state in its pivotal decisions. This is achieved through the competencies and cadres of Algerian university graduates. Furthermore, the role of academic student organizations is also highlighted by receiving their suggestions and opinions in various fields and addressing them scientifically.
