Item الرقابة على الانتخابات في الجزائر في ظل الأمر رقم 21-01 المعدل والمتمم(جامعة غرداية، كلية الحقوق و العلوم السياسية، قسم الحقوق, 2023-06) بوطبة, مصطفى لمين; طالب أحمد, فاروقتشكل الانتخابات الطريق الديمقراطي الأساسي لإسناد السلطة، وعليه يتوجب حماية جميع العمليات الانتخابية بالضمانات القانونية والقضائية المطلوبة لتحقيق الشفافية والنزاهة المفترضة في الانتخابات، ولا يمكن أن يتحقق ذلك إلا من خلال تطبيق جملة من الآليات التي تباشرها الجهات المكلفة بالرقابة على الانتخابات، فقد عهد الأمر رقم 21-01 المتضمن القانون العضوي المتعلق بنظام الانتخابات في الجزائر هذه المهمة لكل من السلطة المستقلة الانتخابات باعتبارها الهيئة المكلفة بتنظيم الانتخابات والرقابة عليها، ثم الرقابة القضائية في شكليها الإداري والجزائي، ثم رقابة المحكمة الدستورية على مختلف العمليات الانتخابية. Elections constitute the basic democratic path for assigning power. And accordingly all electoral processes must be protected by the legal and judicial guarantees required to achieve the supposed transparency and integrity in the elections. and this can only be achieved through the application of a number of mechanisms that are initiated by the authorities charged with monitoring the elections. as Order No. 21-01 has entrusted The organic law related to the electoral system in Algeria includes this task for each of the Independent Elections Authority as the body in charge of organizing and supervising the elections, then judicial oversight in its administrative and penal forms, then the oversight of the Constitutional Court over the various electoral processes.
