    الحماية الجنائية من جرائم العدوان الصهيوني على غزة

    تطرقنا في هذا الموضوع دراسة معمقة وتحليل شامل لموضوع الحماية الجنائية المكرسة للمدنيين الفلسطينيين في قطاع غزة، مع إيلاء اهتمام خاص للأوضاع الصعبة التي يواجهونها نتيجة سلسلة من الاعتداءات العسكرية الصهيونية المتكررة. وقد أسفرت عن انتهاكات خطيرة لأحكام القانون الدولي الإنساني والقانون الجنائي الدولي، خصوصًا ما يرتبط بارتكاب جرائم الحرب والجرائم ضد الإنسانية. تهدف الدراسة في جوهرها إلى استيضاح مدى كفاءة وفعالية القواعد القانونية الدولية المعمول بها، وعلى وجه الخصوص اتفاقيات جنيف ونظام روما الأساسي للمحكمة الجنائية الدولية، في حماية المدنيين الفلسطينيين من هذه الانتهاكات. كما تسلط الضوء على الجهود الممكنة لمحاسبة مرتكبي الجرائم الصهيونية. بالإضافة إلى ذلك، تركز المذكرة على الكشف عن التحديات والعوائق التي تواجه تحقيق العدالة الجنائية الدولية في السياق الفلسطيني، بما في ذلك العراقيل السياسية والقانونية التي تُمكّن الاحتلال الصهيوني من الإفلات المستمر من المساءلة القانونية، وذلك نتيجة الدعم الذي تحظى به من بعض القوى الكبرى على الساحة الدولية. This study presents an in-depth examination and compréhensive analysis of the Criminal protection afforded to Palestinian civilians in the Gaza Strip, with spécial attention given to the Harsh conditions they endure as a result of repeated Israeli military assaults. Thèse assaults have led to serious violations of international humanitarian Law and international Criminal Law, particularly in relation to war crimes and crimes against humanity. At its core, the study aims to clarify the efficiency and effectiveness of the existing international legal frameworks, particularly the Geneva Conventions and the Rome Statute of the International Criminal Court, in protecting Palestinian civilians from such violations. It also seeks to shed light on the possible efforts to hold perpetrators of Israeli crimes accountable. In addition, the thesis focuses on exposing the challenges and obstacles that hinder the realization of international criminal justice in the Palestinian context, including the political and légal barriers That enable Israël to continuously évade légal accountability, largely due to the support it receives from certain major powers on the international stage.

    الضمانات القانونية لممارسة البحث العلمي في التشريع الجزائري

    لقد أدى الإهتمام المتزايد بالبحث العلمي إلى جعله حرية تحضى بمكانة خاصة وجعلها من الأساسيات التي يجب على الدول أن تهتم بها، ونظرا لمدى مساهمته في تحقيق التطور والتقدم سارعت معظم التشريعات إلى الإهتمام بهذه الحرية بإعتبارها الفاصل الحاسم في تحديد مدى تقدمها ومكانتها وعليه المشرع الجزائري كغيره من التشريعات وضع مجموعة من الضمانات كحماية لهذه الحرية سواء من خلال الجانب المؤسساتي لتنفيذ وتوجيه نشاط البحث أو العقابي لردع أي مساس بحقوق الملكية الفكرية وتفادي وقوع أي سرقة علمية خوفا من التعرض للعقوبات. The growing interest in scientific research has made it a freedom of special status and one of the basics that countries must care about. In view of the extent of its contribution to development and progress, most legislation has been quick to take care of this freedom by considering it to be the decisive divider in determining its progress and status. Algerian legislation, like other legislation, has put in place a series of guarantees for the protection of this freedom, whether through the institutional aspect to carry out and direct research or punitive activity to deter any infringement of intellectual property rights and to avoid any scientific theft for fear of punishment.
