Item الأحكام المتعلقة بتعدد الزوجات _دراسية فقهية _(جامعة غرداية, 2022) معمر, قوادريتناولت هذه الدراسة موضو أحكام المتعلقة بتعدد الزوجات _ دراسة فقهية _ فبعد أن عرفت لفظ الزواج والنكاح لغة وشرعا، تطرقت الى مشروعية تعدد الزوجات وشروطه، وأراء بعض العلماء المعاصرين فيه، ثم عالجت المسائل والأحكام المرتبطة بتعدد الزوجات من خلال القرآن الكريم والسنة النبوية، أ وقوال العلماء حسب حدود الدراسة. حيث تعرفت أن لفظ النكاح من المصطلحات القرآنية لذا عنون الفقهاء كتبهم بكتاب النكاح، وأن استعمال لفظ الزواج مصطلح حديث شا استعماله مع الفقهاء المعاصرين. كما أن موضو تعدد الزوجات نالته عناية العلماء حديثا وقديْا، دارت نقاشات طويلة حول مشروعيته والحكمة منها، مع أن القران الكريم والسنة النبوية القولية والعملية فصلت في تشريعه وأن فطرة ربانية. كما تنا ولت الدراسة القسم وأحكامه، حيث أن أساسه العدل بين الزوجات في النفقة والكسوة والمبيت وسائر الأمور المادية كما قال رسول الله صلى الله صلى الله عليه وسلم " اللهم هذا قسمي فيما .« أملك، فلا تلمني فيما تملك ولا أملك كما عرضت المذكرة مسائل أخرى تتعلق بتعدد الزوجات، كمسألة السكن الخاص بالزوجة الذي هو سبب الكثير من المشاكل الأسرة في وقتنا الحاضر، وهي مسألة جديرة أن تكون عنون دراسة مستقلة ولكن بأسلوب الحاضر وواقعه المتشابك.This study dealt with the subject of provisions related to polygamy - a jurisprudential study - after knowing the term marriage and marriage, both in language and in Sharia, it touched on the legality of polygamy and its conditions, and the opinions of some contemporary scholars on it, then it dealt with the issues and rulings related to polygamy through the Holy Qur’an And the Sunnah of the Prophet, and the sayings of scholars according to the limits of the study. As I learned that the term “marriage” is one of the Qur’anic terms, so the jurists titled their books with the Book of Marriage, and that the use of the term “marriage” is a modern term that is commonly used with contemporary jurists. Moreover, the issue of polygamy has received the attention of scholars, both in recent times and in the past. There have been long discussions about its legality and the wisdom of it, even though the Holy Qur’an and the verbal and practical Sunnah of the Prophet were separated in its legislation and that it is a divine instinct. The study also dealt with the oath and its provisions, as its basis is justice between wives in terms of alimony, clothing, accommodation, and other material matters, as the Messenger of God, may God’s prayers and peace be upon him, said: “Oh God, this is my oath in what I possess, so do not blame me for what you own or your mother.” The memorandum also presented other issues related to polygamy, such as the issue of the wife's private housing, which is the cause of many casesItem الأحكام المتعلقة بالسحر في الفقه الإسلامي(جامعة غرداية, 2020) عائشة, سلاماتThe phenomenon of witchcraft is one of the dangerous phenomena in society، which has spread terribly in the present time، over the ages the magic has had an impact in the emergence of mythical superstitious beliefs، the prophet has forbidden the harrah upon him، so this phenomenon continued to decrease from generation to generation despite the achievement of the contemporary human being a great deal of science and interpretation of social phenomena scientifically. Through all of this، we have tried in this study، which is characterized by the provisions on magic in Islamic jurisprudence، to identify the concept of magic and its types، and to spend some of the provisions on this subject، and to identify the factors of the spread of magic and its spread . In the end، we point out that Allah has made every disease medicine، as well as magic، which only harms the permission of Allah، so God has prescribed for us ways of treatment that we have had to follow.Item الأحكام المتعلقة بالمرأة في الحج(جامعة غرداية, 2018) حسيني, مريمتناولت هاته الدراسة موضوع الأحكام المتعلقة بالمرأة في الحج حيث تم في البداية الولوج بمطلب تمهيدي يتضمن ماهية الحج والرخصة ، حيث بعدها تطرقت الدراسة إلى المباحث التي تضمنت استطاعة المرأة للحج وأحكام المرأة في الإحرام يليه بعد ذلك أحكام المرأة في الإحرام والطواف ومضامين حكم المرأة في رمي الجمار ما جعل هاته الدراسة تتضمن كل الاحكام والتفاصيل والاجراءات والفروض الشرعية لاحكام الحج التي تعني وتخص المراة .This study dealt with the issue of provisions relating to women in Hajj, where initially a preliminary requirement was entered, including what is Hajj and the license The study then dealt with the investigators, who included the ability of women to make a pilgrimage and the provisions of women in Ihram, followed by the provisions of women in Al Ahram, Al-Raf and the contents of women's judgement in the throwing of jewels. This study included all the provisions, details, procedures and legitimate imposition of Hajj provisions, which meant and belonged to women.Item مرتبة العفو في الأحكام وعلاقتها بمقاصد الشريعة(جامعة غرداية, 2014) طه الأمين, لزهاريItem كتاب "الإيضاح" للشيخ عامر بن علي الشماخي (ت 792هـ/1279م) -دراسة وتحقيق كتاب الشركة(جامعة غرداية, 2022) حسن, الدبوزيعتبر الشيخ عامر بن علي الشماخي (ت792هـ/1279م) أحد أبرز أعلام المدرسة الإباضية الذين ساهموا في مجال التأليف، مع قلة العناوين التي تركها، إلا أن كتابه "الإيضاح" برز بروزا واضحا في المذهب، فاهتم به الطلبة وأشاد به العلماء قديما وحديثا، واعتمده الفقهاء المغاربة مرجعا للفتوى في زمانه إلى يوم الناس هذا وفي مختلف حواضر الإباضية، كما اهتم به المشارقة كثيرا، وحظي بالاعتناء به حاشية واعتمادا وتلخيصا ونسخا وطباعة، إلا أنه لم يحظ بتحقيق علمي يبرزه كما ألَّفه مؤلفُه، ويكشف عن مكنوناته ومنهجه، ومن هذا المنطلق جاء هذا البحث لدراسة قسم من أقسامه وتحقيقه، تحت عنوان: كتاب "الإيضاح" للشيخ عامر بن علي الشماخي (ت792هـ/1279م) -دراسة وتحقيق كتاب الشركة- وفي هذا البحث تحقيق نص الكتاب بالمقارنة بين نسخه الخطية، وضبط نصه وخدمته، إلى جانب دراسة مضمون هذا النص لمعرفة منهج المؤلف في تأليفه، ودراسة مدى التزامه به في أبواب الكتاب، وبيان ما لم يذكره المؤلف من الجوانب المنهجية للكتاب من ذكر المصادر التي اعتمد عليه، وكذا منهجه في إقرار المسائل وأحكامها وما عليه العمل منها، ومنهج الاستدلال والتعليل في الكتاب.
