Item قاعدة لا ثواب إلا بنية و تطبيقاتها في الفقه الاسلامي(جامعة غرداية, 2020) ربيعة بنت أحمد, بن ساحةThe jurisprudential rules are very important in the graduation, the branching and the jurisprudential rationale, and the jurists have tended to explain the major rules and leave the sub-rules. Islamic fiqh. It has paved the way in the first sections of this study to mention the concept of jurisprudential rules and its types. I also studied in the second topic the concept of a rule that there is no reward except with an intention and its relationship to the rule of af- fairs with its objectives, then explaining the location of the intention, its time, its controls, conditions and divisions. As for the second topic, it deals with the application side of the rule. It contains applications in the chapter on purification, prayer, the Qu ‘ran of hajj, leaving the forbidden and the work of men. And I concluded that with a conclusion in which I mentioned the most important findings of the results and suggested recommendations. Praise be to god in the beginning and the conclusion, and blessings and peace be open the best king prophet.Item ضوابط الضرورة وتطبيقاتها في المعاوضات المالية(جامعة غرداية, 2019) حسين, بن عيسىThis memorandum analysis the necessary legal means which make the taboo permissible. This necessity is regulated by law, so that no person can resort to the prohibited on grounds of necessity; also the study tried to answer the following main problem: What are the necessary controls that allow the violation of the Islamic ruling in the field of financial compensation? I have tried, through my studies, to identify what is necessary and to interview the scholars' opinions, and to mention all the evidence and sections that come under it. Then I mentioned the necessary rules, and limited them to the most important ones. In particular the financial provisions ,then I indicated in a side from uses of treatment in general and the financial reparation in particular with indicating lawful ruling and the effect of necessity in this, and this is with mention the opinions of scientists in applied issues and discussion it .
