    The crime of defamation through modern means of communication -A comparative study between Islamic jurisprudence and Algerian law- Abstract: Modern means of communication have know rapide technologique développement, but the abuse of this technologie by somme led to the émergence of a new type of new crimes that did not existe bifore such as diffamation through social networks. This type of crime raised many questions and difficulties from the scientific and legal point of view of judges and jurists. And In view of the lack of legal provisions governing such offenses and lack of jurisprudence that is being discussed at the level of trials and judicial councils, has led to a legal vacuum in the articles of legislation in the presence of traditional texts that are not sufficient to be applied often to these newly created crimes. In order to clarify this, we have tried to provide an idea of the legal nature of this crime and the legal provisions it regulates under the current traditional legislative texts, We also tried to clarify the position of the most important comparative legislation and compare it with the position of the Algerian legislator, at the end of the research, we will summarize the results and present some recommendations regarding the problem presented in the topic.

    This research’ topic dealt with a precised and important issue in Islamic jurisprudence field, which is the issue of the current Fatwa via channels and modern tools communication. Due to the importance of the Fatwa in people’s life, the research is to deal with the following problematic: What are the mechanisms of Fatwa through channels and modern tools of communication? Wat are its standars, its most important effects, and ways to control its negative effects? In order to answer this problematic, it was inevitable to clarify the reality of the Fatwa through channels and media, and the mechanisms of its running through many different tools of communication, and through artificial intelligence technology as a new fact that imposed challenges on the Fatwa field, the standars of the two parties to the Fatwa (The Mufti and the questioner) the standards of the use of communication tools between them, and induction important positive and negative effects. After answering this problematic, it is concluded that it is inevitable for the Fatwa to keep pace with developments in tools of communication and to invest them in a controlled way as a means to achieve the purpose of clarifying the legal provisions of issues and proving that Sharia is a flexible, valid and effective solution to the humanity’s happiness.
