    أحكام التعامل بالعقود الإلكترونية في الفقه الإسلامي

    مع ازدهار العالم وتطور التكنولوجيا حدثت حركة اقتصادية عالمية كبيرة تربط الأفراد ببعضها، من مظاهر هذا التطور نشوء العقود الالكترونية ،فكان عليا التطرق لها تصورا وحكما ،فإنه لا يحل لمسلم أن يقدم على أمر حتى يعلم حكم الله فيه ،وعليه بينا أحكام التعامل بالعقود الالكترونية في الفقه الاسلامي من خلال بيان : مفهوم العقود الإلكترونية وأشكالها و مخاطرها وطرق تفاديها،كما بحثنا في أركان هذه العقود من (العاقدين و الصيغة ومحل العقد) وبينَّا حكم كل ركن وتكييفه في العقد الالكتروني، كما تكلمنا عن مجلس العقد وصوره الالكترونية الذي يمثل الخطوة الأولى للانتقال إلى الكلام عن آثار هذه العقود الإلكترونية من انتقال الملكية وتسليم المبيع وطرق دفع الثمن،ثم ختمنا نخاتمة ذكرنا فيها أهم النتائج المتوصل إليها خلال هذا البحث كما توصلنا في هذا البحث إلى أن العقود الالكترونية لها نفس أحكام العقود التقليدية ولكن تختلف معها في الشكل والوسائل. وقد توصلت لهذه النتيجة بعد دراسة اقوال الفقهاء من المذاهب من المتقدمين ومن المتأخرين والمعاصرين. With the prosperity of the world and the development of technology, there has been a major global economic movement that links individuals together. One of the manifestations of this development is the emergence of electronic contracts, so Sharia had to address them in concept and judgment. It is not permissible for a person to undertake a matter until he knows God’s ruling on it, and accordingly we will study it. The provisions for dealing with electronic contracts in Islamic jurisprudence in three chapters in which we explain: the concept of electronic contracts, their forms, risks, and ways to avoid them. We will also discuss the pillars of these contracts (the contracting parties, the form, and the subject of the contract) and explain the ruling on each element and its adaptation in the electronic contract. We will also talk about the contract council and its electronic copies, which represents the first step to moving on to talking about the effects of these electronic contracts on the transfer of ownership, delivery of the sold item, and methods of paying the price. Then we conclude with a conclusion in which we mention the most important results reached during this research.

    عقود التجارية الإلكترونية بين الفقه الإسلامي والقانون الجزائري

    من خلال دراستنا لموضوع عقود التجارة الإلكترونية في الفقه الإسلامي والقانون الجزائري يمكننا أن نستخلص مايأتي: باتساعاستخدامات تكنولوجيا المعلومات وكذا الاتصالاتوظهور شبكة الأنترنت، من خلال سرعة انتشارها وقدرتها على ربط المتعاقدين في قاطبة العالم،انجرَ عنه تغيير شكل التجارة وذلك وفق التبادل التجاري في العالم، لتظهر هاته الأخيرة كنوع جديد من التجارة، والتي لا تتم إلاّ بوسائل إلكترونية حديثة من أهمها الأنترنت. إن حجم التجارة الإلكترونية يشهد تطورا مشهودا على المستوى العالمي، إلا أن التجارة الإلكترونية لم تجد بعد ضالتها بعد في الجزائر ولم تحقق لحد الساعة الانطلاقة المرجوة، لكن هذا لا يقلل من المجهودات المبذولة من طرف الجزائر من أجل تطوير مجال الاتصالات ومواكبة التطور التكنولوجي الحاصل في العالم، وإعطاء دفعة للنهوض بهذا النوع من التجارة، واعتمادها كأسلوب حديث للتبادل التجاري في الجزائر. Through our study of the subject of e-commerce contracts in Islamic jurisprudence and Algerian law, we can conclude the following: With the expansion of the uses of information technology, as well as communications and the emergence of the Internet, through the speed of its spread and its ability to connect contractors all over the world, he was forced to change the form of trade according to trade exchange in the world, so that the latter appears as a new type of trade, which can only be done by modern electronic means. One of the most important is the Internet. The volume of e-commerce is witnessing a remarkable development at the global level, but e-commerce has not yet found its way in Algeria and has not yet achieved the desired breakthrough, but this does not diminish the efforts made by Algeria to develop the field of communication and keep pace with the technological development taking place in the world And to give impetus to the advancement of this type of trade, and to adopt it as a modern method of trade exchange in Algeria.
