    أحكام نوازل الصيام المعاصرة

    لا يزال الواقع المعاصر يحدث نوازل في العبادات والمعاملات، والاهتمام بها يعتبر أمرا ذا بال عند العلماء إذ هو من فروض الكفاية فيلزمهم بذلك إظهار حكم الشرع فيها، ومن أهم تلك النوازل ما يتعلق بالعبادات والتي من جملتها الصيام إذ هو من أركان الإسلام وفروض الأعيان، فتأكد بذلك البحث في نوازل الصيام وما استجد فيه من أحكام فقهية تتعلق بالصائم. جاءت هذه الدراسة لتبين آراء الفقهاء فيما استجد من مسائل معاصرة لها أثر على بداية الصوم ونهايته، وإثبات الشهر دخولا وخروجا، وأيضا تعرضهم للنوازل التي أحدثها التطور الطبي وتقنيات العلاج عبر المنافذ الأصلية وغير الأصلية. وكذلك لتنقل اجتهادهم في المستجدات الفقهية التي أنتجتها وسائل العلاج الحديثة عبر المنافذ الخلقية وغير الخلقية. كما جاءت هذه الدراسة كذلك لتؤكد جهود العلماء واهتمامهم مع تعدد مذاهبهم بالتصدي للنازلة من خلال تكييفها وتخريجها على نظائرها للقياس عليها، وتحقيق مناطها للحكم عليها وبيان حكم ما استجد من نوازل معاصرة على عبادة الصيام. The contemporary reality continues to present new issues in worship and transactions, and addressing them is of significant importance to scholars, as it is considered a communal obligation (Fard Kifaya). Scholars are thus required to clarify the Sharia ruling on these matters. Among the most important of these issues are those related to worship, including fasting, which is one of the pillars of Islam and an individual obligation (Fard Ayn). This underscores the necessity of researching new issues in fasting and the recent jurisprudential rulings related to it. This study aims to elucidate the opinions of jurists on contemporary issues that affect the beginning and end of fasting, as well as the verification of the month's entry and exit. Additionally, it addresses the new issues brought about by medical advancements and treatment techniques through both natural and artificial orifices. Furthermore, the study conveys the scholars' efforts in addressing the new jurisprudential matters resulting from modern treatment methods through natural and artificial orifices. This study also emphasizes the scholars' diligence and attention, despite their varying schools of thought, in tackling new issues by adapting them to similar cases for analogy, determining their relevant characteristics for rulings, and clarifying the rulings on contemporary issues affecting the act of fasting.

I have divided the first chapterintotwo sections, in the first section I hadstudiedThe Fact of The LegalLicences, and The Principles of Jurisprudence, and The RelatedTerms. In the second section I hadstudiedRuling of The Legal Licences and Its Applications. In the second chapter I have takensomemodals of theCalamities Of Fasting and Pilgrimage, A Juristic and Thoroughstudy, It was in the form of twosectors, a sector of Fasting and the othersector in Pilgrimage. At the end the conclusion thatincluded the most important findings and recommendations I have foundthatitcontributes to the service of thissubjectwhichis about the study. This studyevenit has aset of resultsof each issue addressed, but at the same time it shows the ability of islamic jurisprudence to provide solutions, and provisions for the new arrivals in fasting and pilgrimage, thatresponds to the reality and challenges of today on the one hand, and commensuratewith the capacitiesand conditions of the taxpayers and theircircumstances on the other hand.
