Item أحكام التصرفات الواردة على الأوقاف في الفقه اللإسلامي(جامعة غرداية, 2022) بلكو, زينبتناول هذا البحث الوقف وجاء بعنوان"أحكام التصرفات الواردة على الأوقاف في الفقه الإسلامي" للإجابة على الإشكالية الرئيسية المتمثلة في: ماهي أحكام التصرفات الواردة على الوقف في الفقه الإسلامي؟ فتضمن مبحثا تمهيديا وثلاثة مباحث اخرى خاصة بالتصرفات الواردة عليه , وكان الهذف منها بيان مفهوم الوقف بتعريفه لغة ,واصطلاحا بين الفقهاء, وذكر أنواعه, بعدة اعتبارات, وأركانه, وشروط أركانه, مع ذكر المختلف فيها والمتفق عليها, وإزالة الغموض عن التصرفات الواردة عليه كالاستبدال, والإجارة, والزكاة, والاستثمار, بذكرها وتعريفها, وتبين حكمها وضوابطها, بين المذاهب الفقهية, ومجالات بعضها, لتختم بخاتمة فيها أهم النتائج المتوصل إليها, مع بعض التوصيات. This research dealt with the waqf and came under the title "The provisions of the acts contained on endowments in Islamic jurisprudence" to answer the main problem: what are the provisions of the acts contained in the waqf in Islamic jurisprudence? It included a preliminary research and three other investigations concerning the actions contained in it, and the delirium included a statement of the concept of endowment by defining it as a language, and a term among jurists, He mentioned its types, several considerations, its pillars, and the conditions of its pillars, with the mention of the different and agreed, and the demystifying of the actions contained on it such as replacement, renting, zakat, and investment, by mentioning and defining it, and showing its rule and controls, between the doctrines of jurisprudence, and the areas of some of them, to conclude with a conclusion in which the most important results reached, With some recommendations.Item إدارة الوقف، ودورها في حمايته وتطويره -دراسة تأصيلية تطبيقية-(جامعة غرداية, 2023) أحمد البشير, بسعودهذا البحث هو دراسة لنظام الوقف في الشريعة وفي القانون، والمقارنة بينهما، ودور إدارة الوقف الشرعية والقانونية في حماية الوقف وفي تطويره، وبيان دور الديوان الوطني للأوقاف والزكاة في تسيير وتنظيم الوقف. This research is a study of the Endowment (donation) system in Sharia and the Law, and a comprison between them, and the role of the legal and religion administration of Endowment (donation) in protecting and developing the endowment, and an explanation of the role of the National Endowment and Zakat office in management and organisation of the Endowment.
